Terms of Service

These Terms of Service govern your use of Super-Tor Sports & Recreation Canada's services, programs, and facilities. By using our services, you agree to comply with these terms.

1. Acceptance of Terms

By accessing our website, registering for programs, or using our facilities, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use our services.

These terms apply to all users of our services, including participants, parents/guardians of minor participants, visitors, and website users.

2. Services Description

Super-Tor Sports & Recreation Canada provides sports and recreation programs, facilities, and related services across Canada. Our services include but are not limited to:

  • Youth and adult sports programs
  • Fitness and wellness activities
  • Senior recreation programs
  • Community events and tournaments
  • Facility rentals
  • Coaching and instruction services
  • Camp and seasonal programs

3. Registration and Eligibility

Program Registration

Registration for programs requires accurate and complete information. You agree to:

  • Provide truthful and current information
  • Update information as necessary
  • Meet age and skill requirements for specific programs
  • Complete required medical and liability forms

Age Requirements

Participants must meet minimum age requirements for programs. For participants under 18, a parent or legal guardian must complete registration and provide consent.

Health and Safety Requirements

Participants must disclose relevant medical conditions and obtain medical clearance when required. We reserve the right to request additional medical documentation or exclude participants when necessary for safety reasons.

4. Payment Terms

Fees and Payment

Program fees must be paid in full by the specified deadline unless payment plan arrangements have been made. Accepted payment methods include:

  • Credit and debit cards
  • Online banking transfers
  • Cash (for in-person transactions)
  • Certified cheques

Refund Policy

Refunds are available under the following conditions:

  • Program cancellation by Super-Tor: Full refund
  • Participant withdrawal 14+ days before start: 90% refund
  • Participant withdrawal 7-13 days before start: 50% refund
  • Participant withdrawal less than 7 days before start: No refund
  • Medical withdrawal with documentation: Prorated refund available

Late Payment

Late payment fees may apply to overdue accounts. Continued participation may be suspended for non-payment.

5. Code of Conduct

All participants, parents, and spectators must adhere to our code of conduct:

Participant Behavior

  • Treat all participants, staff, and volunteers with respect
  • Follow all safety rules and instructions
  • Use appropriate language and behavior
  • Respect facilities and equipment
  • Arrive on time and prepared for activities

Prohibited Conduct

The following behaviors are strictly prohibited:

  • Harassment, discrimination, or bullying
  • Use of alcohol or illegal substances
  • Violent or threatening behavior
  • Damage to property or equipment
  • Unauthorized access to restricted areas

Enforcement

Violations of the code of conduct may result in suspension or permanent expulsion from programs without refund.

6. Safety and Risk Acknowledgment

Assumption of Risk

Participation in sports and recreation activities involves inherent risks, including but not limited to:

  • Personal injury or property damage
  • Contact with other participants
  • Equipment-related injuries
  • Environmental hazards

By participating, you acknowledge these risks and assume responsibility for your safety.

Safety Equipment

Participants must use required safety equipment and follow all safety protocols. Personal protective equipment may be required for certain activities.

Medical Emergencies

In case of medical emergencies, we reserve the right to seek immediate medical attention for participants and will attempt to contact emergency contacts as soon as possible.

7. Liability and Insurance

Limitation of Liability

Super-Tor Sports & Recreation Canada's liability is limited to the maximum extent permitted by law. We are not liable for:

  • Injuries or damages resulting from inherent risks of activities
  • Loss or damage to personal property
  • Actions of other participants
  • Weather-related cancellations or delays

Insurance Requirements

Participants are strongly encouraged to maintain personal health insurance. Some programs may require proof of insurance coverage.

Waiver of Claims

By participating in our programs, participants (or parents/guardians for minors) waive claims against Super-Tor Sports & Recreation Canada for injuries or damages arising from normal program activities.

8. Intellectual Property

Website Content

All content on our website, including text, images, logos, and graphics, is owned by Super-Tor Sports & Recreation Canada and protected by copyright laws. Unauthorized use is prohibited.

Photography and Video

We may photograph or video record activities for promotional purposes. By participating, you consent to such recording and use of your likeness unless you specifically opt out in writing.

User-Generated Content

Any content you submit to us (reviews, comments, suggestions) becomes our property and may be used for promotional purposes.

9. Program Changes and Cancellations

Program Modifications

We reserve the right to modify programs, schedules, or instructors when necessary. Participants will be notified of significant changes as soon as possible.

Weather Cancellations

Outdoor programs may be cancelled due to weather conditions. Make-up sessions will be scheduled when possible, or prorated refunds may be provided.

Insufficient Enrollment

Programs with insufficient enrollment may be cancelled, and full refunds will be provided.

10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy. By using our services, you consent to our privacy practices as described in that policy.

We may use your contact information to communicate about programs, events, and services unless you opt out of such communications.

11. Website Terms

Acceptable Use

You agree to use our website only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use of the site.

Account Security

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

Website Availability

We strive to maintain website availability but do not guarantee uninterrupted access. We may temporarily suspend access for maintenance or technical issues.

12. Dispute Resolution

Informal Resolution

We encourage participants to address concerns directly with program staff or management before pursuing formal complaints.

Formal Complaints

Formal complaints should be submitted in writing to our administrative office within 30 days of the incident in question.

Governing Law

These terms are governed by the laws of the Province of Ontario and the laws of Canada. Disputes will be resolved in the courts of Ontario.

13. Termination

We reserve the right to terminate or suspend your participation in programs or access to services for:

  • Violation of these terms
  • Inappropriate conduct
  • Non-payment of fees
  • Safety concerns

Termination does not entitle you to refunds except as specifically provided in our refund policy.

14. Changes to Terms

We may update these Terms of Service periodically. Significant changes will be communicated to registered participants. Continued use of our services after changes indicates acceptance of the updated terms.

The current version of these terms is always available on our website.
